This case note addresses a preliminary injunction issued by the German Federal Constitutional Court (Bundesverfassungsgericht, “BVerfG”) on 5 July 2023, which ordered the German Parliament (Deutscher Bundestag) to abstain from the second and third readings of a draft law during the then-current week of the parliamentary session. Unprecedented, the Court found that the significantly compressed timeframe of the legislative proceedings may violate the parliamentarians’ constitutional right to deliberation.
