Pierre Bourdieus Rechtsdenken: Die Integration von sozialstruktureller und kulturtheoretischer Perspektive

Bourdieu's legal thought has thus far been understood in a limited way. Existing literature primarily regards Bourdieu's contribution to the analysis of law as that of a field theorist. In this view, Bourdieu stands for a social differentiation perspective of law that is enriched by an analysis of power. In contrast, this article offers a novel interpretation of Bourdieu's conceptualization of the law by an integration of, on the one hand, a social-structural and, on the other, a cultural-sociological perspective. Such a reading clarifies Bourdieu's crucial contribution to socio-legal studies more comprehensively than a field-theoretical reception of the author, underscoring the potential to renew and differentiate the concepts of subject and action as well as the understanding of power and domination within the socio-legal studies.
