Schuldnerhaftung für Roboterversagen: Zum Problem der Substitution von Erfüllungsgehilfen durch Maschinen

Gemäß § 278 BGB hat der Schuldner für das schuldhafte Fehlverhalten seiner Erfüllungsgehilfen einzustehen. Doch wie liegen die Dinge, wenn er Hilfspersonen durch Roboter ersetzt? Der Beitrag legt dar, dass die Haftung für maschinelle "Erfüllungsgehilfen" erhebliche Lücken aufweist. Anschließend zeigt er auf, dass sich die Haftungslücken durch Anknüpfung an eine Regelung aus dem Staatshaftungsgesetz von 1981 systemgerecht schließen lassen.
