Jens Gerlach explains that, from a legal-theoretical and constitutional point of view, the traditional German phenomena of discretion, flexibility in the margin of assessment, and freedom of planning can all be regarded and treated as a uniform decision-making scope of the administration. The question of the extent to which decisions of the administration can prevail over judicial control powers has preoccupied jurisprudence for decades. Embedded in public procurement law, in which is a still rather young field of law, creates particular uncertainty. Why do public authorities have so much room for manoeuvre when it comes to awarding public contracts? The doctrine of the uniform decision-making scope of the administration is able to explain the phenomenon of decision-making scope in public procurement as well, which enables us to reliably track down the leeway granted under public procurement law and provides legal practice with standards for fulfilling this decision-making freedom.
