Die E-Evidence-Verordnung: Pioniermodell für das digitale Zeitalter oder Preisgabe der Staatlichkeit?

Die transnationale Erlangung von elektronischen Beweismitteln stellt die Praxis seit langem vor erhebliche Probleme. Sie hat aber auch das Entstehen innovativer Theorien gefördert. Durch die kürzlich erlassene E-Evidence-Verordnung beschreitet die EU einen neuen Weg der Einbindung Privater in die Rechtshilfe. In diesem Beitrag sollen die Hintergründe der Problematik in ihren vielfältigen rechtlichen Bezügen diskutiert werden, wobei Schwerpunkte auf die theoretische Grundkonzeption sowie auf Rechtsbehelfe und Verteidigungsrechte gelegt werden. Zum Schluss werden Grundzüge eines eigenen Modells vorgestellt.
