Die Diskussionen um das deutsche Schadensrecht (§§ 249 ff. BGB) sind trotz des noch jungen 2. SchadÄndG in vollem Gange. Ein großer Streitpunkt ist dabei, welche Funktionen das Schadensrecht erfüllt und ob es auch strafende Elemente enthält bzw. enthalten darf. Der Beitrag untersucht diese Fragestellung unter zur Hilfenahme der Erfahrungen im englischen Recht. Im Ergebnis befürwortet der Verfasser die Einführung von punitive damages, allerdings unter engen Voraussetzungen und strengen Vorgaben.
