Bodenschutz und Naturschutz begegnen sich als konkurrierende Belange bei der Vorhabenzulassung. Naturschutz ist ein Belang auf Altlasten, u. a. auf Brach- bzw. Flächenrecyclingflächen. Tatsächlich stehen das gesetzlich vorgeschriebene Flächenrecycling und der Naturschutz mit seinen Instrumenten des Flächen- und Artenschutzes, der Eingriffsregelung sowie der Landschaftsplanung in einem Spannungsverhältnis, ja teilweise sogar in einem diametralen Gegensatz zueinander. Während das Naturschutzrecht ausdrücklich die Renaturierung aufgelassener Flächen fordert, folgt das Baurecht dem Postulat des Flächenrecyclings als Bestandteil der Strategie nachhaltigen Städtebaus. In den im Bauplanungsrecht vorgesehenen Abwägungen kann die Wertung aller öffentlichen Belange erfolgen. Dabei können u. a. Gefahrenabwehraspekte, der Belang des zu reduzierenden Flächenverbrauchs sowie auch die Schutzaspekte bezüglich Natur und Landschaft Berücksichtigung finden.
Soil protection and nature conservation meet as competing concerns in the project approval procedure. Nature conservation is a challenging issue dealing with contaminated sites, e. g. during the re-development of brownfield. In fact, there-development and the conservation of nature with its instruments of areas and species protection, the impact regulation and landscape planning are in tension. Sometimes they are even opposed. While nature conservation law explicitly calls for the restoration of abandoned land, construction law follows the postulate of land recycling as part of the strategy for sustainable urban development. In the considerations under planning law, the evaluation of all public interests can take place. This should take, inter alia, aspects of warding-off of risks, of reducing land use as well as of the conservation aspects related to nature and landscape into account.
